Torture and Failure to Investigate – Togo

Summary:
The applicant alleges that following his arrest by state agents in Togo, he was subjected to torture and other forms of cruel, inhuman and degrading treatment while in custody. He contends that he was detained in conditions that violated his dignity and physical integrity and was denied fundamental procedural safeguards during his detention.

The abuse occurred within a broader context of weak accountability mechanisms for misconduct by security forces. Despite filing complaints regarding his treatment, the authorities allegedly failed to initiate a prompt, impartial and effective investigation, and no perpetrators have been prosecuted or sanctioned.

The case argues that the Republic of Togo violated its obligations to prohibit and prevent torture, to guarantee the right to liberty and security of the person, to uphold fair trial guarantees, and to ensure an effective remedy. It further seeks orders requiring the State to conduct proper investigations, provide reparations, and adopt measures to prevent recurrence.
