TFA v. Republic of Cameroon (2018), ACERWC

In May 2018, the African Committee of Experts on the Rights and Welfare of the Child delivered its decision in Institute for Human Rights and Development in Africa & Finders Group Initiative on behalf of TFA (a minor) v. Republic of Cameroon (Communication No. 006/Com/002/2015). The case concerned the rape of a 10-year-old girl in 2012 and the subsequent failure of the authorities to effectively investigate, prosecute, and provide redress. The Committee found that the Cameroon had violated its obligations under Articles 1, 3, and 16 of the African Charter on the Rights and Welfare of the Child, and recommended prosecution of the perpetrator, payment of 50 million CFA (approximately USD 90,000) in compensation, legislative reform, specialised child-protection mechanisms, training of justice actors, and public awareness measures.

At its 46th Ordinary Session in December 2025, the Committee received updated information on implementation. The Government reported that the perpetrator was prosecuted and sentenced in August 2023 to 12 years’ imprisonment and ordered to pay 10 million CFA in damages; he remains detained pending appeal. While the State indicated that processes are underway to provide compensation to TFA, this has not yet been finalised. Cameroon also highlighted legislative and policy measures adopted since the decision, including child-protection initiatives addressing gender-based violence in schools, a national action plan to combat female genital mutilation and early marriage, and training programmes for judicial and law enforcement personnel conducted in collaboration with partners. However, the creation of specialised police units and courts for child protection has reportedly been hindered by financial and human resource constraints.

The Committee reiterated the need to expedite all remedial measures, noting the prolonged trauma suffered by TFA since 2012. Although the victim has reportedly received psychosocial support and assistance with school fees, structural reforms and full compensation remain outstanding. IHRDA will continue to follow up with the Committee and the State to ensure comprehensive implementation of all recommendations and durable protection for child victims of sexual violence in Cameroon.
