Disappearance and murder  – The Gambia

Summary:

This case challenges the failure of the Republic of The Gambia to effectively investigate, prosecute, and ensure accountability for the enforced disappearance and killing of Mahawa Cham and Saul Ndow.

The applicants argue that the State has not conducted a prompt, thorough and impartial investigation into the alleged involvement of state agents, nor taken adequate steps to prosecute those responsible or establish the truth regarding the fate and whereabouts of the victims.

The case further raises concerns regarding the continued failure to return the remains of Mahawa Cham to his family and to provide appropriate reparations.

The applicants contend that these failures constitute violations of the right to life and the right to an effective remedy, and seek declarations of violation, accountability for those responsible, and measures to ensure justice, truth and reparations for the victims’ families.
