Arbitrary Detention and Fair Trial Violations – Burundi

Summary:
The applicant alleges that he was arbitrarily arrested and detained by state authorities in Burundi and subjected to violations of his due process rights. He contends that his detention was not grounded in lawful justification and that the proceedings against him failed to meet fair trial guarantees under the African Charter on Human and Peoples’ Rights.

The application further asserts that the applicant was denied adequate time and facilities to prepare his defence, was not tried within a reasonable time, and did not benefit from an independent and impartial tribunal. It is also alleged that domestic remedies were ineffective or unavailable, leaving him without meaningful recourse. The case argues that the Republic of Burundi violated the right to liberty and security of the person, the right to a fair hearing, and the right to an effective remedy. It seeks declaratory relief and appropriate reparations, as well as measures to strengthen judicial independence and procedural safeguards.
