ACM v. Republic of Botswana (2026), ACERWC

In February 2023, the Institute for Human Rights and Development in Africa (IHRDA) filed a communication before the African Committee of Experts on the Rights and Welfare of the Child on behalf of “ACM,” a child survivor of repeated sexual abuse, in ACM v. Republic of Botswana (Communication No. 0024/Com/001/2023). The case concerned the failure of the Botswana authorities to conduct an effective investigation or initiate prosecution despite repeated reports to the police, and the absence of medical and psychosocial support for the victim. IHRDA argued that these omissions constituted violations of the State’s obligations under the African Charter on the Rights and Welfare of the Child to protect children from abuse, torture, and exploitation.

During its 45th Ordinary Session in Maseru, Lesotho, the Committee facilitated negotiations between the parties, culminating in the signing of an Amicable Settlement Agreement in January 2026. Under the agreement, Botswana undertook to ensure the prosecution of the perpetrator to its final conclusion, provide ACM with comprehensive medical and psychosocial support, and pay financial compensation of USD 7,500. The State also committed to implementing broader national measures to curb child sexual abuse and to ensure effective investigation of future complaints. A progress report was required by the end of December 2025, followed by periodic six-monthly updates until full implementation.

The amicable settlement marks an important milestone in securing justice for ACM and advancing systemic reform. However, the effectiveness of the agreement will depend on sustained follow-through—both in delivering individual remedies and in implementing structural safeguards to prevent recurrence. IHRDA will continue to engage with the Committee and monitor compliance to ensure that the commitments undertaken by Botswana translate into meaningful protection and accountability for children.
