O Instituto para os Direitos Humanos e o Desenvolvimento em África (IHRDA) apresentou a queixa n.º 292/04 perante a Comissão Africana dos Direitos Humanos e dos Povos (ACmHPR) em nome de 14 gambianos que foram presos, detidos e deportados, apesar de residirem e trabalharem legalmente em Angola.

Issues

– Whether the complainants had any reasonable access to local remedies after deportation;

– Se a falta de acesso a recursos internos constitui uma exceção à regra do esgotamento dos recursos internos;

– Se a violação das Regras Mínimas Padrão das Nações Unidas para o Tratamento de Prisioneiros constitui uma violação do artigo 5.º da Carta Africana.

Status of communication

O ACmHPR considerou que o Estado requerido violou os artigos 1, 2, 5, 6, 7, 12, 14 e 15, mas os queixosos não apresentaram provas suficientes para comprovar a violação ao abrigo do artigo 3.

On the issue of the settlement of local remedies the ACmHPR noted the respondent state did not give the Complainants the opportunity to sue in local court.

The communication was decided on merits at the 43rd Ordinary Session of ACmHPR held in Ezulwini, Kingdom of Swaziland. Respondent are required to report Voltar on implementation.
