Brief Facts

The Instituto para os Direitos Humanos e o Desenvolvimento na África (IHRDA) filed communication 249/02 (on behalf of Sierra Leonean refugees in Guinea) before the African Commission on Human and Peoples’ Rights (ACmHPR) against Guinea. Most Sierra Leonean refugees in Guinea alleged to have suffered grave human rights violated, after the Guinean President Lansana Conté made a speech stating that Sierra Leonean refugees in Guinea should be arrested, searched and confined to refugee camps.

Os refugiados serra-leoneses na Guiné sofreram saques e extorsões, violência física, prisões arbitrárias, estupros e revistas íntimas, não restando-lhes outra opção senão permanecer na Guiné e continuar sofrendo esses tratamentos degradantes ou retornar a Serra Leoa, onde a guerra civil ainda estava em curso.

Status of the communication

O Estado demandado teria violado os artigos 2, 4, 5, 12 e 14 da Carta Africana e o artigo 4 da Convenção da UA que rege aspectos específicos dos problemas dos refugiados em África. A comunicação foi decidida no mérito, na 36ª instância.^th Ordinary Session of the ACmHPR held in Dakar, Senegal.
